By accessing the Site or purchasing from us, you agree to these Terms of Service (the “Terms”) and any referenced policies (Returns & Refunds, Shipping, Warranty, and Privacy). If you do not agree, do not use the Site.

We may update these Terms by posting a revised version on this page. Your continued use constitutes acceptance of changes.

Our store is hosted by Shopify Inc., which provides the e-commerce platform.

2. Eligibility and Acceptable Use

You must be the age of majority in your state or have parental/guardian consent to use the Site.

You agree not to use the Site or products for any unlawful purpose, to violate any applicable laws or third-party rights, or to submit false, misleading, or harmful content. Prohibited uses include introducing malware, scraping, spamming, interfering with Site security, or attempting to bypass any technical or shipping restrictions (including hazmat rules applicable to batteries).

We may refuse service or cancel orders when necessary to protect customers, comply with law, prevent fraud/abuse, or address policy violations.

3. Information Accuracy

We aim for accuracy but do not warrant that Site content (including product descriptions, compatibility notes, pricing, availability, or transit times) is error-free. Content may be updated without notice. Product photos are illustrative; actual items may vary within stated specs.

4. Product Availability, Orders, and Acceptance

All orders are offers to buy. We may accept or reject any order in our sole discretion (for example, due to inventory limits, address issues, or suspected fraud). If we cancel after charging you, we will issue a refund.

We may limit quantities per person, household, account, payment method, or address. We will attempt to notify you using the contact details you provide.

5. Pricing, Taxes, and Errors

Prices may change without notice. Sales tax and any required environmental or recycling fees will be calculated at checkout where applicable.

If a product is listed at an incorrect price or with incorrect information, we reserve the right to refuse or cancel orders placed with that information. If your payment has already been processed, we will promptly refund the amount charged.

Discounts, promotions, and free-shipping offers are subject to posted terms and may be modified or withdrawn at any time.

6. Payment and Billing

You agree to provide current, complete, and accurate billing and shipping details. Submitting a payment method authorizes us (and our payment processors) to charge the total order amount, including applicable taxes, shipping, and fees.

For security, certain orders may require additional verification or may be declined.

7. Shipping, Risk of Loss, and Title

Shipping and handling are governed by our Shipping Policy. Risk of loss and title pass to you upon delivery to the carrier. We provide tracking where available and will assist with carrier investigations for lost or damaged packages; see the Shipping Policy for timelines and requirements.

Some products must ship ground-only under hazmat rules; service options can be limited by law or carrier constraints.

8. Returns, Refunds, and Exchanges

Returns, refunds, and exchanges are governed by our Returns & Refunds Policy. Please obtain an RMA before sending any item back and follow all hazmat packing instructions where applicable. Items returned without an RMA may be refused.

9. Warranty

Product warranty coverage is governed by our Warranty Policy. We provide a limited warranty against defects under normal use for the period stated in that policy or the product page. This warranty does not cover misuse, improper installation, modifications, or damage from external causes.

10. Third-Party Services and Links

The Site may offer or link to third-party tools, content, carriers, or services. Use of third-party offerings is at your own risk and subject to their terms and privacy policies. We are not responsible for third-party sites or services.

11. User Content, Feedback, and Submissions

If you submit reviews, questions, photos, or suggestions (“Submissions”), you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display such Submissions for lawful purposes (e.g., customer support, marketing, product improvement). You represent that you own or have permission to share your Submissions and that they do not violate any rights or laws.

We may monitor, edit, or remove Submissions at our discretion but have no obligation to do so.

All content on the Site (including text, graphics, logos, product data, and software) is owned by us or our licensors and is protected by applicable IP laws. You may not copy, reproduce, distribute, or create derivative works without our express written permission, except as permitted by law.

Your use of the Site is subject to our Privacy Policy, which explains what we collect and how we use and protect personal information. We enforce HTTPS across the Site and use industry-standard safeguards; no method of transmission or storage is 100% secure.

Except as expressly stated in our Warranty Policy or as required by law, the Site, products, and services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant uninterrupted or error-free operation.

15. Limitation of Liability

To the fullest extent permitted by law, My New Battery (TWO KINGS ONE JESTER LLC) and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising from or related to your use of the Site or products.

To the extent any liability is not excluded, our total liability for any claim shall not exceed the amount you paid for the product or service giving rise to the claim.

Some jurisdictions do not allow certain exclusions or limitations; in such cases, the above will apply to the maximum extent permitted by law.

16. Indemnification

You agree to indemnify and hold harmless My New Battery and its affiliates from any claim, demand, loss, or expense (including reasonable attorneys’ fees) arising out of your violation of these Terms, your misuse of the Site or products, or your infringement of any law or third-party right.

17. Force Majeure

We are not responsible for delays or failures caused by events beyond our reasonable control, including acts of God, natural disasters, labor disputes, war, terrorism, government action, supply chain disruptions, or carrier issues.

18. Severability; No Waiver

If any provision of these Terms is found unlawful or unenforceable, the remaining provisions will remain in full force. Our failure to enforce any provision is not a waiver of our right to do so later.

19. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.

20. Governing Law; Venue

These Terms are governed by the laws of the State of Nevada, without regard to conflicts of law principles. You agree to the exclusive jurisdiction and venue of state or federal courts located in Clark County, Nevada, for any dispute not subject to informal resolution.
